1. About CustomFox
CustomFox ("we", "us", "our") is an Australian custom apparel business operating at customfox.com.au. We are registered in Australia with an ABN and are GST registered. We offer print-on-demand custom apparel, including T-shirts, hoodies, and caps, using Direct to Film (DTF) printing technology.

2. Acceptance of Terms
By visiting our website, creating an account, using our product customiser, or placing an order, you confirm that you have read, understood, and agree to these Terms and Conditions, together with our Privacy Policy.
If you are placing an order on behalf of a business or organisation, you confirm that you have authority to bind that entity to these terms.
You must be at least 18 years of age, or have parental or guardian consent, to place an order with us.
3. Placing an Order
Order Process
When you place an order through our website, you are making an offer to purchase the products described. Your order is not confirmed until you receive an order confirmation email from us. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or stock unavailability.
Order Accuracy
You are responsible for reviewing your order — including product type, size, colour, and any customisation details — before completing checkout. Because our products are made to order and personalised, we are unable to make changes after an order is confirmed. Please double-check everything carefully before placing your order.
Order Confirmation
Once your order is accepted, you will receive a confirmation email. This email constitutes acceptance of your offer and forms the basis of our agreement with you. Keep this email for your records.
Custom orders: Once an order enters production, it cannot be cancelled or modified. This is because each item is printed specifically for you.
4. Custom Products & Personalisation
Made to Order
All products sold by CustomFox are made to order using Direct to Film (DTF) printing. Each item is printed individually after your order is placed. Production typically begins within 1–2 business days of order confirmation.
Colour Accuracy
Colours displayed on your screen may vary slightly from the finished printed product due to differences in monitor calibration, screen brightness, and the nature of fabric printing. We take care to represent our products as accurately as possible, but minor colour variation is not considered a defect.
Design Placement
Print placement may vary by a small margin (typically up to 1–2cm) from the position shown in the product customiser. This is within industry standard tolerance and is not considered a defect.
Customer-Supplied Designs
When you use our customiser to create or upload a design, you are responsible for the final design you submit. We print what you submit. If your submitted design contains spelling errors, low-resolution images, or layout issues that were visible in the customiser preview, these are not considered printing defects and do not qualify for a refund or reprint.
Print Quality
We use DTF printing technology which produces vibrant, durable prints. For best results, images should be high resolution (at least 150 DPI at print size). We reserve the right to contact you if a submitted image is of insufficient quality for printing, though we cannot guarantee this in all cases.
5. Intellectual Property
Our Intellectual Property
All content on the CustomFox website — including text, graphics, logos, product photography, pre-designed templates, and the overall design of our store — is owned by or licensed to CustomFox. You may not reproduce, distribute, or use any of our content without our express written permission.
Customer Designs — Your Warranty to Us
By submitting a design, image, text, or any other content for printing, you warrant that:
• You own the intellectual property rights in the content, or have obtained all necessary licences and permissions to use it for this purpose
• The content does not infringe the intellectual property rights, trademarks, or any other rights of any third party
• The content does not include any material that is unlawful, defamatory, offensive, or otherwise prohibited
• You have the right to grant us a limited licence to reproduce and print the content as part of fulfilling your order
Indemnity
You agree to indemnify and hold CustomFox harmless from any claims, damages, or costs (including legal costs) arising from your breach of the warranties above — including any claim by a third party that your submitted content infringes their intellectual property rights.
Our Right to Refuse
We reserve the right to refuse to print any design that we reasonably believe infringes third-party rights, is unlawful, promotes hate speech or violence, is sexually explicit, or is otherwise objectionable. In such cases, we will contact you and offer a full refund.
Important: Do not submit copyrighted logos, brand marks, sports team insignia, or celebrity images unless you have explicit written permission from the rights holder. Submitting such content is your responsibility — not ours.
6. Pricing & Payment
Pricing
All prices displayed on our website are in Australian Dollars (AUD) and include GST unless otherwise stated. We reserve the right to change our prices at any time without notice. Price changes do not affect orders that have already been confirmed.
GST
CustomFox is registered for GST in Australia. GST is included in all displayed prices. A tax invoice will be provided with your order confirmation email.
Payment Methods
We accept payment via Shopify Payments (credit and debit cards), and Afterpay. Payment is processed at the time of order. All payment processing is handled securely by our payment providers — we do not store your payment card details.
Afterpay
Afterpay is provided by Afterpay Pty Ltd and is subject to Afterpay's own terms and conditions. Eligibility for Afterpay is determined by Afterpay, not by CustomFox.
Pricing Errors
In the event of a pricing error on our website, we reserve the right to cancel an order and issue a full refund. We will notify you as soon as possible if this occurs.
7. Shipping & Delivery
Dispatch
Orders are dispatched after production is complete. Production typically takes 2–5 business days from order confirmation. You will receive a dispatch notification with tracking details once your order has been shipped.
Delivery Timeframes
Estimated delivery timeframes are provided at checkout and in your confirmation email. These are estimates only — we cannot guarantee delivery by a specific date. Delays caused by Australia Post, courier services, or circumstances outside our control are not the responsibility of CustomFox.
Delivery Address
You are responsible for providing a complete and accurate delivery address at checkout. We are not liable for orders that are lost, delayed, or undeliverable due to an incorrect address provided by you. If a parcel is returned to us due to an incorrect address, you may be charged for redelivery.
Risk and Title
Risk in the products passes to you upon dispatch. Title (ownership) passes to you upon receipt of full payment.
Delivery Area
We currently ship to Australian addresses only.
8. Returns, Refunds & Your ACL Rights
Your Australian Consumer Law rights: Our products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms limits your rights under the ACL.
Custom and Personalised Products
Because all CustomFox products are made to order and personalised specifically for you, we are unable to accept returns or offer refunds for change of mind. This is consistent with the Australian Consumer Law, which recognises that change-of-mind returns are at the discretion of the retailer for made-to-order goods.
When We Will Offer a Replacement or Refund
We will offer a replacement or full refund in the following circumstances:
• The product has a manufacturing defect (e.g. a print error, garment defect, or quality issue that is our fault)
• The product we delivered is materially different from what you ordered (e.g. wrong size, wrong garment, significantly incorrect print)
• The product is damaged in transit
• The product does not meet the consumer guarantees under the Australian Consumer Law
What Is Not Covered
• Errors in text, spelling, or design content that were visible in the customiser preview and submitted by you
• Minor colour variation due to screen calibration or fabric printing characteristics
• Minor print placement variation within industry standard tolerance
• Sizing issues where you ordered the incorrect size — please refer to our size guides before ordering
• Change of mind
How to Make a Claim
If you believe your order has a defect or error, please contact us at support@customfox.com.au within 14 days of receiving your order. Include your order number and clear photographs showing the issue. We will assess your claim and respond within 3 business days.
Tip: Always check the preview carefully in the customiser before confirming your order. What you see in the preview is what we print.
9. Limitation of Liability
To the maximum extent permitted by law (and subject always to the Australian Consumer Law), CustomFox's total liability to you for any claim arising from your use of our website or products is limited to the amount you paid for the relevant order.
We are not liable for any indirect, incidental, special, or consequential loss — including loss of profit, loss of data, or loss of opportunity — even if we have been advised of the possibility of such loss.
We do not exclude or limit any liability that cannot be excluded under the Australian Consumer Law or any other applicable law.
10. Prohibited Use
You must not use our website or services to:
• Submit designs containing hate speech, racial vilification, or content that discriminates against any person or group
• Submit designs containing sexually explicit, obscene, or pornographic material
• Submit designs that depict or promote violence, self-harm, or illegal activity
• Infringe the intellectual property rights of any third party (see Section 5)
• Engage in fraudulent activity or provide false information
• Attempt to gain unauthorised access to our systems or disrupt the operation of our website
• Use automated tools, bots, or scrapers to access our website without permission
• Resell our products without our express written permission
We reserve the right to refuse service and cancel orders that violate these conditions, without refund where the violation was caused by the customer.
11. Website Use
Availability
We aim to keep our website available at all times, but we do not guarantee uninterrupted access. We may need to take the site offline for maintenance, updates, or due to circumstances outside our control. We are not liable for any loss resulting from website unavailability.
Accuracy of Information
We take care to ensure product descriptions, pricing, and other information on our website is accurate. However, errors may occasionally occur. We reserve the right to correct errors and update information without notice.
Third-Party Links
Our website may contain links to third-party websites. These are provided for convenience only. We have no control over and accept no responsibility for the content, privacy practices, or availability of those sites.
12. Privacy
Your personal information is collected and handled in accordance with our Privacy Policy, which is available at customfox.com.au/policies/privacy-policy. By using our website and placing orders, you acknowledge our Privacy Policy and consent to our use of your information as described in that policy.
13. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for the resolution of any dispute arising under or in connection with these terms.
For customers in New Zealand, your rights under the New Zealand Consumer Guarantees Act 1993, the Fair Trading Act 1986, and the Contract and Commercial Law Act 2017 are not affected by these terms.
Dispute resolution: We encourage you to contact us directly at support@customfox.com.au before initiating any formal dispute process. Most issues can be resolved quickly and informally.
14. Changes to These Terms
We may update these Terms and Conditions from time to time. When we do, we will update the "Last updated" date at the top of this page. We encourage you to review these terms periodically.
Continued use of our website after any changes constitutes your acceptance of the revised terms. Changes do not apply retrospectively to orders that have already been confirmed.
